How Do I File for Divorce in Canton, Ohio?

In the state of Ohio there are some requirements.  So, make sure you are within the parameters before trying to file for divorce.

  • Have had to live in Ohio for at least six months
  • Have had to live in that particular county for at least 90 days
  • File your petition of divorce or dissolution with the Clerk of Courts in that county
  • Are required to pay a filing fee (a few hundred dollars)
  • Can apply for a waiver, if you’re low income

After you have understood and done the above, then your spouse will be served divorce papers. Your spouse has 28 days to respond and they can do a “counterclaim,” then there is a hearing.

During the Hearing in Ohio:

  • Assets and debts you have as a couple are disclosed
  • A decision is made for a settlement or a trial date is set

If children are involved it becomes more of a process because of living and financial situations that need to be decided on. You may need to make changes to your divorce outcome if there are still problems with your spouse and any agreement that may have been made.  This is where we come in.
